Recovery Agreement
Last updated October 1, 2026
This Recovery Agreement sets out how TRACE GLOBAL PRIVATE LIMITED (CIN U46309TS2026PTC223264) finds, files and collects utility refunds and credits for you on a contingency basis. It is incorporated into your order form and sits alongside the Terms of Service. Where this agreement and an order form differ, the order form controls for the point it addresses.
1. Scope of recovery services
Trace Global audits the utility accounts you designate, identifies billing errors such as wrong rate schedules, demand ratchet errors, power factor penalties, meter multiplier errors, estimated reads, duplicate bills, tax on exempt usage and billing on closed sites, quantifies the overcharge for each period still open to recovery, and files refund claims with the utility or its regulator.
2. Letter of authorization
You sign a letter of authorization that lets Trace Global request bills and account history, communicate with named utilities, and file and pursue claims in your name for the accounts you list. The letter is limited to those accounts and that purpose, and it does not allow Trace Global to change service, sign contracts or move money on your behalf.
You may revoke the letter at any time by written notice to recovery@traceglobal.si. Revocation stops new filings and does not affect the fee on claims already filed, as section 7 states.
3. You keep the utility relationship
The utility account stays in your name. You keep control of service, payment, contracts and day-to-day contact with your utility. We tell you before we file and give you the evidence packet, and we will not contact a utility about an account you have told us to exclude. Trace Global is not a utility, an energy supplier or a law firm.
4. Recovery fee
The recovery fee is a percentage of refunds and credits actually received by you or applied to your account for claims we filed. The percentage is stated in your order form. Under the standard Recovery Audit plan it is 35 percent, and under Continuous Audit it is 20 percent together with the platform fee stated in the order form.
A refund counts when the utility issues a check, payment or bill credit, measured at the amount actually received or applied. Interest the utility pays on a refund is included in the amount recovered. Amounts the utility only promises, or disputes, are not received.
5. No recovery, no fee
If a claim recovers nothing, you owe no recovery fee for it. Recovery Audit has no platform or setup fee. We bear our own costs of analysis, evidence preparation, filing, follow-up and escalation, including regulator complaints we file.
6. Prospective savings from rate changes
Where a recovered error shows that an account should move to a different rate schedule, or a correction such as a meter multiplier or power factor fix lowers future bills, we call the lowered future bills prospective savings. We share prospective savings for 24 months from the effective date of the change, at the same percentage as the recovery fee, measured as the difference between what the account would have been billed under the prior treatment and what it is billed after the change.
We report the calculation each month, and the share is invoiced only on savings that appear on bills you have received. After 24 months the savings are entirely yours. You may decline a rate change we recommend. In that case no prospective savings fee applies.
7. Invoicing, payment and survival
We invoice the fee within 30 days after the end of the month in which the refund or credit is received, with a statement showing the claim, the amount received and the fee. Payment is due within 30 days. Where the utility applies a bill credit, we invoice against the credit value when it appears on a bill.
If this agreement ends, or you revoke the letter of authorization, the fee remains payable on any refund or credit received later for a claim we filed before the end date, and on prospective savings under section 6 for rate changes effected on our recommendation.
If a utility later claws back a refund we have invoiced, we credit the matching fee against future invoices or refund it.
8. Your cooperation and customer-found errors
You will give us accurate account lists, bills and information we reasonably request, and tell us of disputes you already have open with a utility. Errors you have already submitted to a utility in writing before the start date, and refunds already confirmed in writing, are excluded and listed in your order form. Errors we find independently are ours even if you later learn of them.
9. Utility decisions and limits on claims
Utilities and regulators decide claims under their tariffs and rules, and back-billing and refund periods differ by state and utility. We cannot promise a recovery amount or a time frame. We file only claims that we believe are supported by the tariff and the evidence, and we tell you if we decide not to pursue one.
10. Confidentiality and data
We handle your bills and account data under the Terms of Service and the Data Processing Addendum. We do not name you to utilities, regulators or others without your consent, except as needed to file the authorized claims.
11. Governing law
This agreement is governed by the laws of India, and the courts at Hanamkonda, Telangana have exclusive jurisdiction. The parties will first try to settle a dispute in good faith through their account leads and then through senior executives for 30 days. Questions go to recovery@traceglobal.si.
